New pool building contract

SPASA NSW and the MBA have put together a new swimming pool contract.

It is based 70 per cent on the old MBA contract, and about 30 per cent on the old SPASA contract. It has been approved by both the SPASA and MBA solicitors.

SPASA NSW President Manfred Wiesemes said they’ve combined the contracts to make it easier for everybody. “I would like to see everyone in the industry using this contract,” he says. “A lot of work has gone into this contract and it covers just about everything that can be covered. The contract will have both association badges on the front. It will be available to members and also to non-members, who will pay a premium for it.”

SPASA hopes to sell the contract as a package with a handover book. “We all know the customer likes to call six months after the pool’s been handed over, saying they’ve never seen a warranty card, or you didn’t tell them how to backwash the filter. We produce a handover book which is available in duplicate, so the customer signs that after you’ve done the handover. Then the customer and the builder both know you’ve completed the handover,” he says.
